Man convicted of soaking arthritic neighbour with freezing water from a hose in row over ‘moving a rubbish bin’ has lodged a court appeal

A man convicted of assault after soaking an arthritic neighbour with “freezing” water from a hose after a row erupted about a rubbish bin allegedly being moved has had bail fixed for appeal.

Adrian William Harbison (53), of Esdale Terrace at Balnamore near Ballymoney in County Antrim, had previously been convicted in his absence of common assault relating to an alleged incident on May 31 last year.

He appeared at Coleraine Magistrates Court on Monday by arrangement to answer an arrest warrant.

A prosecutor told the court police received a report from a woman’s daughter saying her mum had been “soaked” by her neighbour after going out to get a bin.

The court heard it was alleged Harbison, who had been fixing a motorbike, had moved the bin and when the woman spoke to him about it he told her to “get to f**k” and turned a hose on her on two occasions soaking her top.

The court heard the woman suffered from arthritis and found the water “freezing”.

Defence barrister Francis Rafferty said the defendant maintained his innocence and that he had not committed an offence.

The court heard the defendant claimed to have brought the woman’s bin in.

For assault Harbison was fined £250 and issued with a two year restraining order.

Bail was fixed for appeal on the sum of £250.
